According to the Bexar County Criminal District Attorney’s Office, on July 17, 2020, two San Antonio Police Department (SAPD) officers responded to a domestic violence call at a North Side apartment complex involving Foster.

When officers arrived to investigate, Foster began shooting at them. In total, he fired 17 shots from a pistol and 5 times from a shotgun. The officers returned fire and managed to incapacitate him.

After the verdict and while being transported to prison, Foster jumped out of his wheelchair and ran several blocks before he was caught. He now faces an additional charge for escape.

Bexar County District Attorney Joe Gonzales said in a news release:

We support our San Antonio police officers and are grateful that they were not injured. Our office will continue to pursue justice for all crime victims, especially those who put their lives on the line every day to keep our community safe.
