LLM student sues Jindal Global Law School over use of artificial intelligence in exams

Lawyer and Jindal Global Law School (JGLS) student Kaustubh Shakkarwar has sued the university by filing a petition against him for failing the exam due to the alleged use of artificial intelligence in his testimony.

In the lawsuit, Shakkarwar’s legal team denied that he used artificial intelligence in his original filing, as noted by artificial intelligence detection tool turnitin. The legal document also indicates that there is no clear institutional ban on the use of artificial intelligence.

“(…) The petitioner received an email from the ‘Unfair Measures Commission’ which was completely unsubstantiated and contained the words ‘UMC case – 88% AI-generated report’ along with a PDF document, without explanations, justifications or allegations, but only puzzling wording,” part of the legal justification stated, while another part questioned the idea that the use of artificial intelligence amounts to plagiarism when the institution did not explicitly mention it.

The petition also highlighted weaknesses in the Turnitin tool and its tendency to sometimes generate false positives when detecting AI-generated text, which the company itself addressed.

“This petition was drafted by Kaustubh Shakkarwar and argued by Prabhneer Swani with input from our former intern Nitya Ranga. This will aim to legislate artificial intelligence and intellectual property around the world. We at KAS & Co || “Attorneys and legal advisors strive to push the boundaries of intellectual property law,” the law firm said on LinkedIn on Monday (November 4, 2024).

According to his website, Shakkarwar is also involved in the development of AI-based generative tools for legitimate users.

“Since the matter is subjudicial in nature, we cannot comment on the matter at this time. We will present our arguments in court and seek justice against OP Jindal Global University,” said lawyer Prabhneer Swani in a statement to Indian.

Indian approached OP Jindal Global University for a statement but received no response.
