Benjamin Cook faces six counts of aggravated assault in connection with the shooting, according to the Department of Justice Hamilton County Sheriff’s Office. Additional charges may be filed pending the outcome of the investigation.

The sheriff’s office said deputies responded to the 6300 block of Stoney River Drive on Friday on a report that a man had shot at a family of six playing outside in the snow.

Initial information at the scene indicated that the parents and their four children were walking down the street to go sledding near a nearby hill, deputies said.

However, around 11:30 a.m., the family said they heard gunshots coming from the direction of a home on a hill near the 10400 block of Birchwood Pike. The mother said she observed snow floating above the ground just a few feet from her 1-year-old son.

The parents immediately looked in the direction where the shot came from and shouted at the man, later identified as Cook, to stop shooting. The man claimed that the family was staying on his property, but the family replied that they were not on his property.

The family then gathered their belongings and returned home before reporting the incident to authorities.

Deputies went to the shooter’s home and spoke with Cook. They also obtained photos from a neighbor that showed Cook in form-fitting clothing walking through the woods with a black rifle slung across his back.

Cook was then arrested aggravated assault charges.
