Judge rules that Diddy’s accuser must reveal her name or rape case will be thrown out

The woman who anonymously sued Sean “Diddy” Combs for a rape that took place earlier this month, she was told she had to reveal her name or her claim would be rejected.

For NBCThe woman’s complaint was filed under a “Jane Doe” address in the Southern District of New York, alleging that Combs raped her in 2004 at a Manhattan hotel when she was a 19-year-old college student.

Texas lawyer Tony Buzbee – who revealed that it had cooperated with 120 people who presented new claims against the disgraced rapper – filed a lawsuit under the Gender-Based Violence Victims Protection Act, which allows victims to file older claims within a two-year period (ending in March 2025).

The case in question was one of six filed by Buzbee on October 14, all of which were anonymous.

The complaint alleged that Jane Doe was invited to one of Comb’s photo shoots in Brooklyn in 2004, after which she and her friend attended an after-party where they were invited to a “more exclusive party” hosted by Combs.

According to her complaint, she and her friend agreed and were taken to the Marriott Hotel in Manhattan by a member of Combs’ entourage. Doe and her friend were allegedly kidnapped and taken to a separate bedroom separate from the main party and locked inside with the rap mogul.

Records show Combs allegedly gave them drinks, made them take cocaine and forcibly touched them. He allegedly ordered Doe’s friend to perform oral sex “or he would have them both killed,” and raped Doe.

At one point, a security guard opened the door and Doe’s friend ran out, but Doe was told to stay and waited about half an hour until another security guard came and told her she could leave, according to the complaint.

In a ruling issued Wednesday (Oct. 20), U.S. District Judge Mary Kay Vyskocil said that while the case is highly sensitive and will likely require high-level public scrutiny if Doe goes by her own name, her desire to remain anonymous did not outweigh her interests. Combs and society “in the customary and constitutionally embedded presumption of publicity” in judicial proceedings.

Judge Vyskocil then found that the woman’s complaint did not provide sufficient evidence that she would be at a “substantial risk of harm” if her name were made public, and that her lawyers “provided no support for this claim” – other than the fact that 20 years ago, Combs allegedly threatened Doe’s life if he fled during the alleged assault.

The complaint notes that Combs has had no contact with Doe in the years since the alleged incident and that Combs is currently being held.

Combs was arrested in September in New York and later charged with sex trafficking, racketeering and transportation for prostitution. He pleaded not guilty to all charges. He was later refused bail after offering a $50m (£38.4m) bond and it was reportedly placed on suicide watch while awaiting trial. He is in federal custody at the Metropolitan Detention Center in Brooklyn, New York. Combs’ next court appearance is December 18. According to Rolling Stoneif found guilty, he could face up to 15 years in prison.

The judge gave Jane Doe until November 13 to file a complaint on her own behalf “or the case will be dismissed.” She found that Doe’s lawyers did not present sufficient evidence that revealing her identity would cause psychological harm, and concluded that the prospect of “public humiliation” was not enough.

Buzbee in a statement filed CNNsaid: “We have great respect for the court and its rulings. Our job as advocates for these victims is to protect their safety as best as possible, which we have tried to do by filing cases anonymously. Anonymous or not, this case will continue, period.

“As we have said before, Mr. Combs cannot respond to every new publicity stunt, even in response to claims that seem ridiculous or patently false,” it says.

“Mr. Combs and his legal team have full confidence in the facts and the fairness of the judicial process. In court, the truth will prevail: Mr. Combs has never committed sexual assault or trafficked anyone – male or female, adult or minor.”
