A university student held in an accessory-to-trial case is released on bail

Noida: A second-year law student, who was arrested in connection with abetment of suicide following the death of her classmate last Saturday, has been granted bail by a Noida court on an emergency basis.
The two, who were in a relationship but ended it when their families did not agree to the relationship, were at a party at a mutual friend’s apartment in Supreme Towers in Sector 99 when the 24-year-old LLB student, a resident of Kaushambi, allegedly jumped to his death from the seventh floor . Four other students present in the apartment were released after questioning.
The student’s lawyer, KK Singh, argued that there was no evidence to justify such an action – the classmate who died by suicide left no note and her bank statements did not reflect any money transfers from him, an allegation made by friend’s family.
“The case is based solely on the suspicions of the victim’s family. The police complaint stated that the boy pursued the girl for a relationship, which she refused. The relationship is mutual, not one-sided. We have also submitted statements of the girl and her mother to the bank showing that there were no records of transfer of funds as alleged in the FIR,” he told the court.
The lawyer also argued that the police’s actions would disrupt her academic work and ruin her career.
Deputy District Attorney Shilpi Bhadoria told TOI that the girl was produced before the court of Additional District Judge Priyanka Singh on Monday at 4.30 p.m. “Her lawyer applied for regular bail, but after the hearing, the court granted interim bail. A regular bail hearing is scheduled for January 17. The court asked the police to present evidence and general arrest log data at the next hearing. – she said
The criteria for arrest in abetment cases have been clearly laid down by the Supreme Court in a judgment in October 2024. “The ingredients constituting an offense under Section 306 of the IPC (abetment of suicide) would be fulfilled if suicide was committed by the deceased as a result of direct and alarming inducement /incitement on the part of the accused, leaving no other option than committing suicide,” the SC said in its ruling.
In a complaint lodged at the Sector 39 police station, the boy’s father alleged that the friendship between his son and the girl had deteriorated in the last three months, leading to “mental harassment”.
“My son withdrew around Rs 2.50 lakh from my bank account and transferred it to the bank accounts of the accused and her mother. “I suspect my son was being harassed for money,” the complaint stated.
Meanwhile, Singh alleged that the police illegally detained five students, including three girls, on Saturday afternoon after the boy’s death. “The students were forced to sit at the Sector 39 police station from Saturday evening to Monday afternoon without any legal action. They later arrested my client for aiding suicide under Section 108 of the BNS and released the remaining four,” he said.
DCP (Noida) Ram Badan Singh said that the police arrested the girl only after conducting an inquiry based on the allegations. “We interviewed five students who were in the apartment to determine their involvement in the matter. Four of them were released and one was arrested,” he said.
